What’s New?

Yes, You Need to Update Your Employee Handbook!

by Julia Melnicoe Insel | | October 10, 2022

If you’re like us, you spent this past legislative session under the delusion that 2023 would be a breeze for employers.  “The Governor would never sign such a ridiculous bill creating a right to 5 days of bereavement leave!,” we told ourselves. We regret to report that our optimism was misplaced.

You will need to revise your handbook to address several new laws and amendments for 2023, including changes to qualifying family members under the California Family Rights Act and sick leave law (in addition to the dreaded bereavement leave).  And, if you didn’t update last year, you may be missing some key best practices recommendations. (If it’s been more than two years, let’s talk—no judgment, we promise).

Finally, if you’re an employer dealing with the remote work boom, you need to ensure your handbook reflects that reality.  For example, if your personal appearance policy only addresses how employees should be dressed in the office, you may be unpleasantly surprised by what your employee decides is the perfect outfit for a Zoom meeting from home.

We encourage you to sign up for our Annual Legal Update to get Shaw Law Group’s in-depth explanation of the new laws and recommendations for 2023, including those that will affect your handbook.  If you need assistance drafting or revising your policies, please contact our Employee Handbook and Policy Practice Leader, Julia Melnicoe Insel.
