On August 23, 2022, U.S. Citizenship and Immigration Services (USCIS) announced that it had reached its H-1B cap selections for fiscal year (FY) 2023. USCIS confirmed that it has sent nonselection notifications to registrant employers and their representatives.

Registrations that were properly submitted, but not selected, will now show as follows:

Not selected – not eligible for an H-1B cap petition based on this registration.

USCIS will continue to accept and process petitions for those who are otherwise cap-exempt or who have already been counted previously against the cap.

Ogletree Deakins’ Immigration Practice Group will continue to monitor developments with respect to these and other policy changes and will post updates on the Immigration blog as additional information becomes available. Important information for employers is also available via the firm’s webinar and podcast programs.
