Top NLRB Lawyer Backs Remote Unfair Labor Practice Hearings

National Labor Relations Board officials in regional offices should schedule remote hearings for most unfair labor practice cases due to the Covid-19 pandemic without awaiting approval from headquarters, the agency’s top lawyer said.

But regional officials should consult with the agency’s operations and management division prior to setting hearing dates if there are unusual aspects in a particular case that would make a trial via video technology unfeasible, NLRB General Counsel Peter Robb said in an Aug. 25 memo.
