In a landmark decision today, United States v. Windsor, the Supreme Court decided by a 5-4 decision that ยง 3 of the federal Defense of Marriage Act (DOMA) is unconstitutional as a deprivation of the liberty of the person protected by the due process and equal protection clauses of the Fifth Amendment.
