John K. Archibald and Tony S. Troese — partners in Goldberg Segalla’s Workers’ Compensation practice — co-authored an article for Claims and Litigation Management Alliance on the keys to mitigating exposure to workers’ compensation claims.  

The attorneys eyed three keys for businesses to manage their risk and save litigation costs. They include surveillance, witnesses, and vocational rehabilitation.  

Monitoring company equipment and vehicles can help minimize third-party claims and quickly identify accurate damages. As long as employers are upfront about surveillance, and transparent about its use, that should limit concerns John and Tony said.   

“Vocational rehabilitation places the burden on the employee to put in the effort to cooperate with the return-to-work plan and job-search efforts,” they wrote. “A good vocational plan and counselor are often the determining factor in avoiding a permanent total disability claim.”
