A unanimous New Jersey Supreme Court has ruled that individuals seeking punitive damages under the state Conscientious Employee Protection Act (CEPA) must present clear and convincing evidence of upper managementβs actual participation in the wrongful conduct or willful indifference to the wrongful conduct.
