Caroline J. Berdzik Details Employment Law Concerns Facing the Senior Care Industry in DRI’s In-House Defense Quarterly

Caroline J. Berdzik, chair of the Health Care and Employment and Labor practices at Goldberg Segalla, contributed an in-depth exploration of employment law issues confronting senior care operators in an article for In-House Defense Quarterly published by the Defense Research Institute (DRI).

In addition to reviewing the wage and hour vulnerabilities for long-term care operators and the issue of marijuana use by facility employees, Caroline discusses the industry’s frequent use of staffing agencies and the legal impact that can have on providers.

“Errors made by staffing agencies can come back on providers as they will generally be viewed as joint employers. It is important for facilities to scrutinize the contracts they have in place with staffing agencies,” Caroline writes.

In the article, Caroline also provides senior care operators a number of best practices to follow in order to avoid wage and hour litigation, which includes management and staff training, employee communications, policies, and payroll audits.
