Double-Clicking Into OFCCP’s Final PDN Rule
On August 3, the Office of Federal Contract Compliance Programs (OFCCP) published its final Pre-Enforcement Notice and Conciliation Procedures rule in the Federal Register. It will go into effect on September 5, 2023. OFCCP will host an informational session regarding the rule on September 5, 2023.

First Circuit Holds That Puerto Rico’s Law 41-2022 Is Null and Void
On August 10, 2023, the U.S. Court of Appeals for the First Circuit affirmed the U.S. District Court for the District of Puerto Rico’s decision declaring Law 41-2022 null and void ab initio.
Illinois Governor Signs Pay Transparency Legislation Into Law
Illinois has joined the wave of jurisdictions passing pay transparency requirements. On August 11, 2023, Illinois Governor J.B. Pritzker signed a bill into law that will require employers to include pay ranges in job postings beginning in 2025.
Verbal Disclosure of Employee’s COVID-19 Status Didn’t Breach Health Record Disclosure Law, Wisconsin Appeals Court Rules
On July 27, 2023, the Wisconsin Court of Appeals held in Mosley v. Oakwood Lutheran Senior Ministries that verbal disclosure of an employee’s COVID-19 status does not support a violation of Wisconsin healthcare record disclosure laws or a cause of action for invasion of privacy.
California Poised For Indoor Heat Illness Regulation
Cal/OSHA has long been able to cite employers for violating stringent outdoor heat illness regulations, that apply to all “outdoor places of employment.” As a consequence, indoor work spaces subjected to high heat conditions have largely been untouched by Cal/OSHA, or held to much looser standards.
That is all about to change with Cal/OSHA’s new indoor heat illness regulation, which is positioned to be approved in the coming weeks. With both heat illness regulations, Cal/OSHA will have full authority to enforce heat-illness standards across all workplace environments, and all California workers will be covered by either the indoor or outdoor standard.
