The Superior Court of the Virgin
Islands recently held that several provisions
of an employee’s arbitration
agreement were unconscionable and
thus, unenforceable. According to the
court, a provision requiring employees
to provide notice to their employers
within 30 days of the event forming
the basis of the claim fails to give
employees sufficient time.
