Mr. Byergo is a Shareholder in the firm’s Kansas City office, with 17 years of experience representing and advising management in labor and employment matters.  Recent successes include:Obtained federal court jury verdict in April 2007 for national big box retailer on claim of workers compensation retaliation under Kansas law.Obtained federal court jury verdict in May 2007 for national specialty retailer on race discrimination claims brought by customer under Section 1981.
Obtained federal court summary judgment for an international auto manufacturer on claims by 119 retirees for special retirement incentives under ERISA and LMRA.Negotiated new collective bargaining agreement covering over 900 firefighters for the City of Kansas City without any work disruption or adverse publicity. His traditional labor experience includes representing management in well over 100 NLRB hearings and labor arbitrations, covering issues ranging from strike and bargaining disputes, to subcontracting and mass layoffs, to discipline and discharge cases.  He has served as chief negotiator for management in collective bargaining in various industries, and successfully advised management in union representation campaigns covering as many as 1800 employees in locations from Alaska to the Virgin Islands. His employment litigation experience is also extensive, with consistent successful results for employers facing discrimination, harassment, retaliation, wage & hour, and other federal and state law claims.  When a cost-effective settlement has not been possible, he has obtained summary judgment or a defense verdict after trial in 100% of such cases. A native of Kansas City, Mr. Byergo began his career in Chicago with another national labor and employment practice.  He then served two different Fortune 100 companies in lead labor relations and legal roles before returning to private practice in 2004.
