Mr. Smalley’s global immigration practice emphasizes the representation of clients in the information technology, healthcare, life sciences, and hospitality fields; professional athletes; and other business professionals.  He possesses extensive experience with temporary and permanent visas, administrative and appellate litigation, and overseas consular processing and the representation of clients in Asia.  Mr. Smalley advises clients regarding immigration compliance, including I-9 audits and defense, discrimination, Social Security no-match issues, and identity theft.  He represents employers in government enforcement actions brought by the Department of Homeland Security, Immigration and Customs Enforcement, and Department of Labor. In addition to his experience with U.S. immigration matters, Mr. Smalley is the manager of Emigra Ogletree Worldwide, which provides comprehensive global immigration service to our clients in more than 100 countries throughout the world.  Mr. Smalley has been named to Business North Carolina’s Legal Elite.  Mr. Smalley is a frequent lecturer and presenter, and has served as a speaker regarding international recruiting in the software and high technology fields, employer compliance, and I-9 and IRCA issues.Prior to joining the Firm, Mr. Smalley was an attorney with an immigration and nationality law firm in Washington, D.C., where he practiced in the area of business-related immigration law in partnership with the former Commissioner of the U.S. Immigration and Naturalization Service.  Other previous experience includes handling civil litigation and trial matters.
