David J. Fishman represents management and individual entrepreneurs in all aspects of litigation from inception through resolution. Mr. Fishman handles all facets of the litigation process in labor and employment disputes. He has defended employers against charges of race, sex, age, national origin, ancestry, and disability discrimination; harassment; retaliation; wrongful discharge in violation of public policy; and defamation. He has specific experience under the California Fair Employment and Housing Act, Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and other labor and employment laws. Mr. Fishman also has experience defending employers in wage and hour class actions including claims for overtime violations, meal and rest period violations, waiting time penalties, and other purported wage and hour violations under federal and California wage and hour laws.Mr. Fishman advises clients regarding various personnel policies and procedures, employee discipline matters, employee handbooks, wage and hour issues, and other employment issues. Mr. Fishman also conducts employee training and investigations at the workplace. Mr. Fishman has handled arbitration and mediation on behalf of his clients. Mr. Fishman has co-authored two articles entitled Labor and Employment Update: Developments in Sexual Harassment Law (March 2002) and Labor and Employment Update: Significant Legislative Developments (March 2002). Mr. Fishman received his law degree from the University of Southern California in 2001 and received his Bachelor of Arts degree from Emory University. While attending law school, he was the Senior Editor of the University of Southern California Law Review.
