The federal appellate court with jurisdiction
over California employers
recently held that an employee who
claimed that she was harassed by customers
is entitled to a new trial. According
to the Ninth Circuit Court of
Appeals, the trial judge erred by not
instructing the jury that the employer
could be held liable for not properly
responding to the worker’s complaints
of racial and national origin harassment
by customers.
