The ELinfonet (pronounced "ee el infonet") discussion list (the “DL”) is a forum for employment lawyers, benefits lawyers, immigration lawyers, corporate counsel and HR professionals who focus on workplace law and employee relations issues. As a cyber-water cooler, the DL offers an opportunity for practitioners to pose questions, offer advice, and share information. Discussion group participants determine the topics for discussion. Membership to the DL must be approved by elinfonet.com, LLC. Prospective members must either be lawyers focusing on workplace law issues, HR professionals or consultants who advise employers on employer/emloyee management issues. In addition, any lawyer seeking membership to the list, but first list in the elinfonet.com lawyer directory (there is a no charge membership level). The DL is a monitored but unmoderated list. This means that list members are expected to self-police and responsibly participate. Here are some simple rules which reflect the list's culture and expectations: 1. Only messages emanating from a subscribed address will be automatically distributed to the list. If you're subscribed as Joe@Lawyer.com, posts from an alternate address such as Joe@aol.com will not be automatically distributed to the list. If you have multiple addresses, consider subscribing from each, setting all but one to NOMAIL. 2. Introduce yourself by stating your name, where you work, and something interesting about your job and your life. We just want you to put a “face” to your email address. 3. List traffic will vary, but with active participation may amount to a large number of emails. Please be prepared to delete freely or use an email filter or separate email address for messages. 4. Be extremely judicious in your use of the "reply to all" button. If you are replying with a message that just says “thanks for the information,” a request to receive a copy of what someone has offered to share, or simply to agree with someone (such as “me, too”), do not reply to the entire group. Instead, send your response directly to the e-mail address of the person who posted the message. 5. Attachments, including business cards, are prohibited. Messages containing any kind of attachment will not be distributed to the list. 6. Use the "subject line" to concisely identify the message topic for your also-busy colleagues. Designate posts about non-legal or non-HR topics by adding OFF-TOPIC or WC ("Water Cooler") to the subject line. DO NOT SEND MESSAGES OF A POLITICAL OR PARTISAN NATURE! While we invite non-legal and non-HR topics, they must be of a general, benign nature (e.g., “Anyone know of a great sushi restaurant in Philadelphia?”). The are other forums for political and partisan discussions – this is NOT one of them. 7. Abbreviate original messages when one is posting a reply. Use
to identify where unnecessary words were deleted. Do not post an entire e-mail only to add a short response. 8. Attorneys are solely responsible for ensuring that their messages meet all applicable ethical standards. It is your license that is on the line. 9. The list is not designed as a means for shameless self-promotion. Messages that are not content-driven will not be delivered. 10. Occasionally, list members have questions which they would like to post but for reasons of privacy prefer anonymity. The list manager may post those questions on behalf of list members. 11. Subscribers should post no more than five messages per day. When that threshold has been met, the message will not be processed, and it should be reposted after midnight. For this reason, subscribers should consider before posting whether a message should be distributed to the entire list or made privately. 12. Remember that all listserve exchanges become property of elinfonet.com, LLC. Remember that all listserve exchanges potentially can by read by anyone. Do not email anything that you would not want posted on the front page of the New York Times. 13. We will not tolerate abusive or otherwise inappropriate messages. We are the sole arbiter of what is acceptable! Your membership is at-will and can be terminated at any time. You are subject to the terms of use set forth on www.elinfonet.com/terms.php. Failure to heed the rules below may result in sanctions. a. Do not insult, berate, or personally attack other list members. The list manager reserves the right to impose sanctions, which include moderating a subscriber’s posts, suspension of posting privileges, and removal from the list for violation of list rules. Violators will be publicly warned. 15. Any requests regarding administrative tasks such as being added or removed from a list should be made to the appropriate area, not the list itself. 16. elinfonet.com, LLC provides the facilities for the DL and no approval or endorsement by elinfonet.com, LLC of any messages posted on the DL should be implied therefrom. By using the DL, users agree to indemnify, defend and hold harmless, elinfonet.com, LLC and its subsidiaries, affiliates, officers, agents, and parent from and against all loss, claims, demands, causes of action, liabilities, expenses, including reasonable attorney's fees and costs arising from any claim arising out of or resulting from in whole or part any breach of these guidelines by the user or any omission or act taken by the user.
