What is the minimum wage you must be paid?
The minimum wage in New Jersey is $7.15 per hour as of October 1, 2006. See N.J.S.A. § 34:11-56a4.
Is your employer required to pay you overtime?
New Jersey requires employers to pay “non-exempt” employees time and a half for any time worked in excess of forty hours per week. See N.J.S.A. § 34:11-56a et seq. Like the federal Fair Labor Standards Act (FLSA), the New Jersey Wage & Hour Law provides that administrative, executive, professional and some other employees are “exempt” and are not entitled to overtime. Determining which employees are exempt and which are not can be a confusing process. How might my employer be violating New Jersey’s wage laws?
Employers regularly violate New Jersey’s overtime laws by classifying employees who should be non-exempt as exempt to avoid paying them overtime wages. Other employers violate these laws when they offer employees “comp time” instead of paying the required overtime.
