He concentrates his practice primarily in litigation of employment related commercial disputes as well as employer counseling. He has represented employers in a wide range of litigation matters in both state and federal court, and before arbitrators, administrative law judges and other tribunals in disputes involving alleged discrimination based on race, sex, age, religion, disability, national origin and the FMLA, sexual and racial harassment, retaliation (including workers’ compensation and whistleblower retaliation), employment contract disputes and other employment related claims. Mr. Witcher has successfully defended numerous employers in actions before the National Labor Relations Board, including representation petitions and unfair labor practice charges. In addition, he has successfully defended numerous enforcement actions brought by MSHA and OSHA, including 110(c) actions, citations issued for fatalities and discrimination claims. Mr. Witcher was named a “Super Lawyer” by Missouri & Kansas Super Lawyers 2005-2007 magazine as the top five percent of attorneys chosen by their peers and through the independent research of Law & Politics of Super Lawyers.
