Mr. Spears has since 1973 counseled and assisted employers with a broad range of employment matters. He has handled litigation in federal and state trial and appellate courts on a wide variety of employment issues, ranging from constitutional and statutory discrimination claims to workplace torts and contract disputes. He has appeared before the United States Supreme Court on two occasions, including the landmark decision in Gilmer v. Interstate/Johnson Lane Corp., 500 U.S. 20 (1991), which enforced an employee's individual arbitration agreement as an alternative to a jury trial under the ADEA.  Mr. Spears is listed in 2007 Super Lawyers, Business North Carolina's Legal Elite, 2008 Edition of The Best Lawyers in America, and 2007-2008 Edition of The International Who's Who of Management Employment Lawyers.

Mr. Spears" defense of employers includes:



Successfully litigating individual and class-action employment discrimination claims brought under Title VII, the ADEA, the ADA, the FMLA, and the Equal Pay Act.

Successfully resolving wrongful discharge, breach of contract, and public policy claims in several southeastern states.

Representing clients facing individual or pattern and practice claims raised by the EEOC and the OFCCP.

Significant years of work with retailers, hospitals, manufacturers, and public agencies in reviewing and implementing personnel policies designed to minimize legal exposures under employment laws and regulations.
