He advises clients on a broad range of matters, including preparing and implementing policies, restructuring multifacility workforces, handling individual and group disciplinary situations, and a host of other issues. Mr. McGuire is an experienced litigator and trial attorney and represents employers in jury and nonjury trials throughout the United States. During the past several years, Mr. McGuire has: Defeated a class-action race discrimination claim for one of the nation's largest soft drink bottlers. Successfully represented employers in several class-action wage and hour lawsuits in state and federal court. Negotiated settlement of an 1,800-member sex discrimination class action for a leading heavy truck manufacturer with no back pay or retroactive seniority for class members. Potential back pay liability was $8-$10 million. Obtained a favorable ruling from the NLRB permitting a Fortune 500 employer to continue using a very successful employee participation program. Drafted employment contacts between small, medium and large employers and key executives.
