Marcus A. McDaniel(Shareholder)Los Angeles Employment Lawyer Lawyer Profile Marcus A. McDaniel represents employers in a broad range of state and federal employment matters. He has extensive experience defending wage and hour class actions, including claims involving classification of employees as exempt from overtime compensation, meal and rest breaks, alleged off-the-clock work and other alleged labor code violations. In addition, Mr. McDaniel regularly handles wrongful discharge, discrimination, sexual harassment, whistleblower, breach of contract, unfair competition, trade secret misappropriation and restrictive covenant disputes. Mr. McDaniel has significant trial experience and has successfully represented employers as lead counsel in jury trials, arbitration proceedings and administrative hearings, including claims for unfair labor practices under the National Labor Relations Act. Mr. McDaniel also advises employers regarding a wide range of employment-related issues, including compliance with wage and hour laws, employee leave, employment and separation agreements, retention of consultants and independent contractors, and privacy rights. He has provided on-site training to clients on a variety of employment-related topics, including diversity awareness, sexual harassment and protection of intellectual property in the workplace. He also has conducted internal investigations into claims of harassment and discrimination. Mr. McDaniel is rated "AV" by Martindale-Hubbell, that publication's highest rating for both legal ability and ethical standards. Mr. McDaniel serves as a mediator on the Los Angeles County Superior Court's alternative dispute resolution panel, where he has successfully mediated cases involving a wide variety of legal disputes. He is also active in the community and currently serves on the Board of Directors of the Constitutional Rights Foundation. Before joining Ogletree Deakins, Mr. McDaniel was a partner in the Los Angeles office of Latham & Watkins LLP.
