Mr. Henning represents employers in both federal and state courts, concentrating his practice in employment litigation, including all types of civil rights and employment-related claims.  Mr. Henning also has significant experience in business and product liability litigation, having represented numerous Fortune 500 companies in numerous federal and state courts across the country.  Most recently, he is representing a large retail corporation in defending two class action lawsuits alleging willful violations of the Fair and Accurate Credit Transactions Act.

Representative cases include:



  • Obtained summary judgment in multiple product liability cases, including claims of failure to warn, strict liability, negligence, and breach of express and implied warranties.

  • Litigated case involving allegations that manufacturing and design defects caused air compressor to explode and injure plaintiff. Settled case with minimal contribution by client.

  • Received summary judgment, recently affirmed by Tenth Circuit, on statute of limitation grounds in medical device case involving allegations that spinal fixation device was defective.

    Mr. Henning further has substantial experience handling cases involving insurance coverage and bad faith, construction defects, premises liability, and personal injury/wrongful death. He has represented several major life, health, and disability insurance companies in cases involving allegations of bad faith and breach of contract.

    Prior to joining Ogletree Deakins in 2007, Mr. Henning practiced with two other large law firms, Baker & Daniels LLP in Indiana and Lewis and Roca LLP in Arizona. While at the University of Virginia School of Law, he clerked with the U.S. Department of Justice, was a semi-finalist in the Lile Moot Court Competition, and was awarded the Ritter Award for Honor, Character, and Integrity.
